{"id":12082,"date":"2026-01-02T21:22:12","date_gmt":"2026-01-03T02:22:12","guid":{"rendered":"https:\/\/resources.evans-legal.com\/?p=12082"},"modified":"2026-01-02T21:22:14","modified_gmt":"2026-01-03T02:22:14","slug":"incapacity-due-to-impaired-short-term-memory","status":"publish","type":"post","link":"https:\/\/resources.evans-legal.com\/?p=12082","title":{"rendered":"Incapacity Due to Impaired Short-Term Memory"},"content":{"rendered":"\n<p>The Orphans&#8217; Court properly found that the alleged incapacitated person (&#8220;AIP&#8221;) was incapacitated and in need of guardianship services, notwithstanding the testimony of the AIP to the contrary, based on medical testimony that the AIP had impaired short-term memory, so that he lacked the ability to make medical, self-care, and financial decisions, as well as the court&#8217;s own observations of the AIP and his difficulty in recalling events and in responding to his own counsel&#8217;s questions.   The evidence also supported the decision of the Orphans&#8217; Court not to direct that the AIP be returned to his home under the care of a guardian as a less restrictive alternative.  <em>In re: Person and Estate of J.P.D.<\/em>, <a href=\"https:\/\/www.pacourts.us\/assets\/opinions\/Superior\/out\/J-S37031-25m%20-%20106627597341424016.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">987 EDA 2025<\/a> (Pa.
