{"id":12328,"date":"2026-05-15T14:00:59","date_gmt":"2026-05-15T18:00:59","guid":{"rendered":"https:\/\/resources.evans-legal.com\/?p=12328"},"modified":"2026-05-15T14:01:01","modified_gmt":"2026-05-15T18:01:01","slug":"guardian-failed-to-prove-payment-of-debt","status":"publish","type":"post","link":"https:\/\/resources.evans-legal.com\/?p=12328","title":{"rendered":"Guardian Failed to Prove Payment of Debt"},"content":{"rendered":"\n<p>The Superior Court affirmed the upholding of objections of the personal representative of the estate of the deceased incapacitated person (the ward) to the account of the guardian, and the resulting surcharge of the guardian, on the following grounds:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The guardian had the burden of proof for contested disbursements, and a promissory note of the deceased ward marked &#8220;paid&#8221; on the same date as a withdrawal from a savings account was insufficient proof of a payment of a debt in the same amount as the withdrawal because there was no proof of the amount actually paid.<\/li>\n\n\n\n<li>The online research and testimony of the personal representative of the ward&#8217;s estate as to the value of vehicles sold by the guardian was sufficient to sustain objections to the sale of the vehicles by the guardian for less than fair market value.<\/li>\n\n\n\n<li>Although annuity contracts payable to a named beneficiary are not part of a decedent&#8217;s estate, the contracts were liquidated by the guardian during the ward&#8217;s lifetime and so the personal representative could object to the exclusion of the annuity proceeds from the account of the guardian. <\/li>\n<\/ul>\n\n\n\n<p><em>In re: Lawrence F.
