{"id":2997,"date":"2015-07-05T12:42:39","date_gmt":"2015-07-05T16:42:39","guid":{"rendered":"http:\/\/resources.evans-legal.com\/?p=2997"},"modified":"2025-02-24T09:19:00","modified_gmt":"2025-02-24T14:19:00","slug":"attorney-general-offices","status":"publish","type":"post","link":"https:\/\/resources.evans-legal.com\/?p=2997","title":{"rendered":"Attorney General Offices and Notices"},"content":{"rendered":"<p>There are several circumstances under which notice must be given to the Attorney General of Pennsylvania:<\/p>\n<ul>\n<li>When a will has been probated that includes gifts to charities of more than $25,000, or which will not be be paid in full, notice must be given to the AG in accordance with <a href=\"http:\/\/www.pacodeandbulletin.gov\/Display\/pacode?file=\/secure\/pacode\/data\/231\/chapter8010\/chap8010toc.html&amp;d=reduce#10.5.\" target=\"_blank\" rel=\"noopener noreferrer\">Pa.O.C. Rule 10.5(a)(6)<\/a>.<\/li>\n<li>When a will has been probated that includes gifts to any governmental beneficiary, notice must be given to the AG in accordance with <a href=\"http:\/\/www.pacodeandbulletin.gov\/Display\/pacode?file=\/secure\/pacode\/data\/231\/chapter8010\/chap8010toc.html&amp;d=reduce#10.5.\" target=\"_blank\" rel=\"noopener noreferrer\">Pa.O.C. Rule 10.5(a)(7)<\/a>.<\/li>\n<li>If there are no other intestate heirs, then the Commonwealth is a statutory heir under 20 Pa.C.S. 2103(6), and the AG would then need to receive notice in accordance with <a href=\"http:\/\/www.pacodeandbulletin.gov\/Display\/pacode?file=\/secure\/pacode\/data\/231\/chapter8010\/chap8010toc.html&amp;d=reduce#10.5.\" target=\"_blank\" rel=\"noopener noreferrer\">Pa.O.C. Rule 10.5(a)(7)<\/a>.\u00a0(The instructions to REV-1513&#8211;Schedule J of the inheritance tax return&#8211;say that \u201cCommonwealth of PA, Statutory Heir\u201d should be listed in Section II, Part B, &#8220;Charitable and Governmental Distributions.&#8221;)<\/li>\n<li>In any Orphans&#8217; Court proceeding involving or affecting a charitable interest (other than a pecuniary gift of $25,000 or less that has been or will be paid in full), at least twenty days advance written notice must be given to the AG in accordance with <a href=\"http:\/\/www.pacodeandbulletin.gov\/Display\/pacode?file=\/secure\/pacode\/data\/231\/chapter8004\/chap8004toc.html&amp;d=reduce#4.4.\" target=\"_blank\" rel=\"noopener noreferrer\">Pa.O.C. Rule 4.4<\/a>. \u00a0Also, <a href=\"http:\/\/www.pacodeandbulletin.gov\/Display\/pacode?file=\/secure\/pacode\/data\/231\/chapter8002\/chap8002toc.html&amp;d=reduce#2.5.\">Pa.O.C. Rule 2.5(c)<\/a>\u00a0requires that notice of the filing of an account be given to the AG if proposed distributions are to an estate or trust of which a charity is a &#8220;qualified beneficiary.&#8221;<\/li>\n<li>Under 20 Pa.C.S. <a href=\"http:\/\/www.legis.state.pa.us\/cfdocs\/legis\/LI\/consCheck.cfm?txtType=HTM&amp;ttl=20&amp;div=0&amp;chpt=77&amp;sctn=10&amp;subsctn=0\" target=\"_blank\" rel=\"noopener noreferrer\">\u00a7 7710(d)<\/a>, the Office of Attorney General has the rights of a charitable organization named in trust instrument, including the right of notice of any proceeding or nonjudicial settlement agreement, which should include any notice that may be required to the charitable beneficiaries of a trust under 20 Pa.C.S. <a href=\"http:\/\/www.legis.state.pa.us\/cfdocs\/legis\/LI\/consCheck.cfm?txtType=HTM&amp;ttl=20&amp;div=0&amp;chpt=77&amp;sctn=80&amp;subsctn=3\" target=\"_blank\" rel=\"noopener noreferrer\">\u00a7 7780.3<\/a>\u00a0if the settlor died or was adjudicated incapacitated. \u00a0See also, 20 Pa.C.S.\u00a0<a href=\"http:\/\/www.legis.state.pa.us\/cfdocs\/legis\/LI\/consCheck.cfm?txtType=HTM&amp;ttl=20&amp;div=0&amp;chpt=77&amp;sctn=35&amp;subsctn=0\" target=\"_blank\" rel=\"noopener noreferrer\">\u00a7 7735(c)<\/a> (enforcement of charitable purposes).<\/li>\n<li>There are sections of the PEF Code (Title 20 of the Pa. Consolidated Statutes) requiring notice or consent of the AG under specific circumstances, such as <a href=\"http:\/\/www.legis.state.pa.us\/cfdocs\/legis\/LI\/consCheck.cfm?txtType=HTM&amp;ttl=20&amp;div=0&amp;chpt=72&amp;sctn=3&amp;subsctn=0\" target=\"_blank\" rel=\"noopener noreferrer\">\u00a7 7203<\/a> (charitable trusts having voting control of certain publicly traded business corporations), <a href=\"http:\/\/www.legis.state.pa.us\/cfdocs\/legis\/LI\/consCheck.cfm?txtType=HTM&amp;ttl=20&amp;div=0&amp;chpt=77&amp;sctn=40&amp;subsctn=3\" target=\"_blank\" rel=\"noopener noreferrer\">\u00a7 7740.3(d) and (e)<\/a>\u00a0(termination of small charitable trusts),<a href=\"http:\/\/www.legis.state.pa.us\/cfdocs\/legis\/LI\/consCheck.cfm?txtType=HTM&amp;ttl=20&amp;div=0&amp;chpt=77&amp;sctn=64&amp;subsctn=0\" target=\"_blank\" rel=\"noopener noreferrer\"> \u00a7 7764(d)<\/a> (filling vacancy in trusteeship of charitable trust), and <a href=\"http:\/\/www.legis.state.pa.us\/cfdocs\/legis\/LI\/consCheck.cfm?txtType=HTM&amp;ttl=20&amp;div=0&amp;chpt=77&amp;sctn=99&amp;subsctn=3\" target=\"_blank\" rel=\"noopener noreferrer\">\u00a7 7799.3(d)<\/a> (annual report of pooled trusts for individuals with disabilities).<\/li>\n<\/ul>\n<p>The main office of the Attorney General is 14th Floor, Strawberry Square, Harrisburg, PA 17120.\u00a0 However, the Charitable Trusts and Organizations Section has three regional offices, and it is better practice to send notices relating to charitable interests to those regional offices.
