{"id":5726,"date":"2018-04-12T09:34:50","date_gmt":"2018-04-12T13:34:50","guid":{"rendered":"http:\/\/resources.evans-legal.com\/?p=5726"},"modified":"2020-08-25T09:31:21","modified_gmt":"2020-08-25T13:31:21","slug":"substituted-judgment-to-change-incapacitated-persons-will-2","status":"publish","type":"post","link":"https:\/\/resources.evans-legal.com\/?p=5726","title":{"rendered":"Substituted Judgment to Change Incapacitated Person&#8217;s Will"},"content":{"rendered":"<p>The Orphans&#8217; Court had the power to change the will of an incapacitated person and substitute its judgment for that of the incapacitated person even though changes to an incapacitated person&#8217;s will are not among the specific powers listed in 20 Pa.C.S. \u00a7 5536(b), and the decision of the Orphans&#8217; Court to disinherit stepchildren after their father had disinherited the incapacitated person and her children was supported by a preponderance of the evidence.\u00a0 \u00a0<em>In re: Petition of Sandra Navarra by the Limited Guardian of Her Estate<\/em>, <a href=\"https:\/\/scholar.google.com\/scholar_case?case=3895526426165136722&amp;q=navarra&amp;hl=en&amp;as_sdt=4,39\" data-wplink-edit=\"true\">185 A.3d 342<\/a>, <a href=\"http:\/\/www.pacourts.us\/assets\/opinions\/Superior\/out\/Opinion%20%20VacatedAffirmedRemanded%20%2010350110035307952.pdf\">2018 PA Super 84<\/a> (4\/11\/2018), aff&#8217;ng\u00a0<a href=\"http:\/\/resources.evans-legal.com\/wp-admin\/post.php?post=4577\">7 Fid.Rep.3d 39<\/a> (O.C.
