{"id":7105,"date":"2019-07-23T12:37:05","date_gmt":"2019-07-23T16:37:05","guid":{"rendered":"http:\/\/resources.evans-legal.com\/?p=7105"},"modified":"2019-07-29T17:05:10","modified_gmt":"2019-07-29T21:05:10","slug":"hearing-required-on-enforcement-of-in-terrorem-clause","status":"publish","type":"post","link":"https:\/\/resources.evans-legal.com\/?p=7105","title":{"rendered":"Hearing Required on Enforcement of In Terrorem Clause"},"content":{"rendered":"\n<p>It was an abuse of discretion and a denial of due process to deny a hearing on whether the contestant to a will had probable cause to challenge the validity of the will when the probate appeal was dismissed on a compulsory nonsuit following the close of the contestant&#8217;s case and the proponents of the will did not have an opportunity to present evidence.  The existence of the <em>in terrorem<\/em> clause was not a defense to the will contest and did not need to be included in a new matter.  Including the forfeiture issue in the new matter that was filed did not require the proponents to request a bifurcation or present evidence before moving for a nonsuit.&nbsp;&nbsp;<em>Powell Estate<\/em>,<em> <\/em><a href=\"http:\/\/www.pacourts.us\/assets\/opinions\/Superior\/out\/opinion%20%20vacatedremanded%20%2010397525856951870.pdf\">2019 PA Super 140<\/a> (5\/1\/2019), <em>vacating and remanding,<\/em> 8 Fid.Rep.3d 147 (Philadelphia Co.
