{"id":9177,"date":"2022-05-20T09:33:22","date_gmt":"2022-05-20T13:33:22","guid":{"rendered":"https:\/\/resources.evans-legal.com\/?p=9177"},"modified":"2022-06-26T11:54:11","modified_gmt":"2022-06-26T15:54:11","slug":"proposed-amendments-to-rule-on-small-estate-petitions","status":"publish","type":"post","link":"https:\/\/resources.evans-legal.com\/?p=9177","title":{"rendered":"Proposed Amendments to Rule on Small Estate Petitions"},"content":{"rendered":"\n<p>The Supreme Court Orphans\u2019 Court Procedural Rules Committee is planning to propose amendments to Pa.R.O.C.P. 5.50 governing the petition to settle a small estate in accordance with&nbsp;<a href=\"https:\/\/www.legis.state.pa.us\/cfdocs\/legis\/LI\/consCheck.cfm?txtType=HTM&amp;ttl=20&amp;div=0&amp;chpt=31&amp;sctn=2&amp;subsctn=0\">20 Pa.C.S. \u00a7 3102<\/a>.<\/p>\n\n\n\n<p>In addition to technical and stylistic changes, the proposed amendments would address three issues:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Requiring the probate or lodging of the original will with the Register, rather than attaching it to the petition.<\/li><li>Allowing an explanation for why an inheritance tax return has not yet been filed.<\/li><li>Clarifying that the petition may be served by notice to interested parties, rather than by citation.<\/li><\/ul>\n\n\n\n<p>Any comments on the proposed amendments should be submitted by July 15, 2022.<\/p>\n\n\n\n<p>\u201c<a href=\"https:\/\/www.pacourts.us\/Storage\/media\/pdfs\/20220519\/162307-orphans'rulemakingsmallestaterevisions.pdf\">Proposed Amendment of Pa.
