{"id":9830,"date":"2023-07-09T14:25:00","date_gmt":"2023-07-09T18:25:00","guid":{"rendered":"https:\/\/resources.evans-legal.com\/?p=9830"},"modified":"2023-07-09T14:25:02","modified_gmt":"2023-07-09T18:25:02","slug":"orphans-court-has-jurisdiction-over-ejectment-action","status":"publish","type":"post","link":"https:\/\/resources.evans-legal.com\/?p=9830","title":{"rendered":"Orphans&#8217; Court Has Jurisdiction over Ejectment Action"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The Orphans&#8217; Court has nonmandatory jurisdiction over an ejectment action when there are &#8220;entangled&#8221; counterclaims that are within the mandatory jurisdiction of the Orphans&#8217; Court, but the proper remedy is not the dismissal of the ejectment action brought in the Civil Division but the transfer of the action to the Orphans&#8217; Court.  <em>Estate of Ricky E. Hull v. Melissa S. Showman, <\/em><a href=\"https:\/\/www.pacourts.us\/assets\/opinions\/Superior\/out\/J-S09017-23m%20-%20105592982230686365.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">1277 WDA 2022<\/a> (Pa. Super. 7\/6\/2023) (non-precedential).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">[DBE Note: A possible problem with this decision is the suggestion that the Orphans&#8217; Court had jurisdiction over the ejectment action only because the defendant asserted counterclaims that were within the mandatory jurisdiction of the Orphans&#8217; Court, so the court had nonmandatory jurisdiction under <a href=\"https:\/\/www.legis.state.pa.us\/cfdocs\/legis\/LI\/consCheck.cfm?txtType=HTM&amp;ttl=20&amp;div=0&amp;chpt=7&amp;sctn=12&amp;subsctn=0\" target=\"_blank\" rel=\"noreferrer noopener\">20 Pa.C.S. \u00a7 712(3)<\/a> because there were &#8220;substantial questions&#8221; that were within the mandatory jurisdiction of the court and also matters not within that jurisdiction.
